GENERAL TERMS AND CONDITIONS OF DISTANCE SELLING BY VANHEE PRODUCTS
The customer must always read the general terms and conditions of distance selling before placing an order. Placing an order on the website or by telephone is considered as explicit acceptance of the general terms and conditions of distance selling.

2. GENERALITIES AND DEFINITIONS
These general terms and conditions apply to distance selling (via the website www.vanheeproducts.com) by Vanhee Products within the territory of Belgium. All other terms and conditions are excluded. Vanhee Products may make changes to these terms and conditions at any time. On current contracts, the terms and conditions applicable at the time of the conclusion of the sale shall at all times remain in force. Ordering via the website is only possible if the delivery address allows transport to the permitted countries. By e-mail to info@vanhee.be you can be informed whether delivery in other countries is possible. The agreement is concluded in Dutch. The translation of the terms and conditions in other languages is informative. The further exchange of information will also take place in Dutch or English. The customer will not be able to invoke the fact that he does not have sufficient command of Dutch or English to invoke the inapplicability of one or more conditions.
3. ESTABLISHMENT OF DISTANCE SELLING
To order a product online, the customer must add it to his shopping cart. He then fills in his customer details and chooses the payment method. Finally, to complete the reservation or order, the customer must press the button with the caption “pay” and make the payment. The catalogue of products and their description, which can be found at www.vanheeproducts.com, does not in itself constitute an offer. It is therefore not sufficient to place an order on our website in order to make a sale. The sale is only concluded upon receipt of the confirmation e-mail. Vanhee Products reserves the right, for the safety and security of the customer, to request additional information and, failing this, to refuse to execute the order. Orders showing that the customer has the intention to resell the products himself, orders by minors, large orders or incomplete orders may also be refused by Vanhee Products. The same applies if in the description of the product or the price indication on the website, despite the great care Vanhee Products devotes to the accuracy of the data, an obvious mistake was made.
Availability is indicated for each product. Vanhee Products makes every effort to indicate these data correctly. Nevertheless, it may happen that delivery is not possible due to, for example, inadvertently incorrect stock data or products that are not available from the supplier. In these cases the order will be refused. Vanhee Products will inform the customer as soon as possible and propose a solution. In the event of force majeure, Vanhee Products may suspend its obligations for the duration of the force majeure or definitively dissolve the contract.
4. TRANSFER OF OWNERSHIP
The goods remain the exclusive property of Vanhee Products until such time as the confirmation email that the purchase has been concluded has been sent. The risk of loss or damage shall pass to the customer from the moment the goods are taken possession of.

Prices are VAT included. Shipping costs are not included; these are mentioned separately. All offers are valid as long as they are included on the website and as long as stocks last. The prices indicated are subject to change at any time. If an order is placed, the price applicable at the time the order is placed will apply to this remote sale.
6. PAYMENT
Payment is made exclusively via the online payment methods proposed by Vanhee Products. To ensure safe online payment and the security of your personal data, the transaction data is sent over the internet encrypted with SSL technology. In order to pay with SSL, the customer does not need any special software. In case of late payment, the order will be refused.

7. DELIVERY
All goods are delivered to the address indicated by the customer. For the safety and security of the customer, proof of identity (or a copy) may be requested upon delivery. The customer signs for receipt of the delivery. The delivery is made by courier service.
Any complaint regarding visible damage to delivered goods or damage caused by our suppliers, as well as any complaint regarding an incorrect or incomplete delivery, must, in order to be observed, be notified by e-mail to info@vanheeproducts.com within 24 hours of delivery.
8. DELIVERY PERIOD
The delivery times stated by Vanhee Products are indicative and unenforceable. If a product is ordered that is temporarily out of stock, it will be indicated when the product will be available again. Vanhee Products is not liable for any consequential damages due to late delivery or non-delivery by the appointed carrier. In such cases, the liability will be limited to the value of the goods proven by the customer not to have been received.
9. RIGHT OF REVOCATION
This provision shall only apply to distance selling to consumers. This provision therefore does not apply to purchases that are part of a trade, business, craft or professional activity or to purchases made by legal persons.
The contract may be rescinded without giving any reason within 14 days of delivery. This period commences on the day following receipt of the goods by or on behalf of the customer. The customer can exercise his right of withdrawal by sending a statement to this effect within this period to info@vanhee.be.
During the withdrawal period, the consumer will handle the delivered goods and their packaging with care. The consumer will only unpack or use the goods to the extent necessary to assess whether the consumer wishes to keep the goods. If the goods are no longer in the original and undamaged condition, the consumer can not invoke his right of withdrawal. If the packaging is part of the goods, it must also be in the original and undamaged condition. The consumer shall be liable for any diminished value of the goods resulting from the use of the goods beyond what is necessary to establish the nature and characteristics of the goods.
Immediately and in any event within 14 days of the day on which the consumer communicates his decision to conclude the contract to Vanhee Products, the consumer shall return the goods in one of the following ways:
-The consumer returns the goods by post; at his own expense.
-The consumer returns the goods himself at Vanhee Products in Wervik.
If the consumer withdraws from the agreement, Vanhee Products will refund the full purchase price using the same means of payment with which the consumer carried out the original transaction, unless the consumer has agreed otherwise. The transport costs are not part of the purchase price and therefore remain at the expense of the consumer. Payment shall be made without delay and at the latest within 14 days after the goods have been returned.
10. POSSIBLE COMPLAINTS AND DISPUTES
For any complaints, the customer can contact Vanhee Products by telephone (056 31 10 59) or e-mail (info@vanhee.be). Any dispute is subject to Belgian law. Only the Belgian courts, more specifically those of the district of Ypres, have jurisdiction.
These conditions for distance selling apply from 15.04.2020.
